DouDoujin Terms of Use for External Site Content Article 1: Application of Terms of Use These Terms of Use (hereinafter referred to as "these Terms") apply to all matters related to the use of works posted on the DouDoujin website, operated by DouDouDoujin Co., Ltd. (hereinafter referred to as "the Company"), on sites other than DouDoujin. For matters not stipulated in these Terms, the DouDoujin Service Terms of Use set forth separately by the Company shall apply. If any provision in these Terms conflicts with the DouDoujin Service Terms of Use concerning work usage, these Terms shall take precedence. By using the site, Users are deemed to have agreed to these Terms and the DouDoujin Service Terms of Use. Article 2: Language The official version of these Terms and any Individual Terms shall be in Japanese. If there is any discrepancy between the Japanese version and versions in other languages, the Japanese version shall prevail. Article 3: Definitions of Terms The terms used in these Terms are defined as follows: 1. "This Site" refers to the website located at "next.doudoudoujin.com". 2. "Submission Information" refers to any data or content, such as images, text, audio, and other information related to posted works, that a user transmits, distributes, posts, uploads, registers, or edits (hereinafter referred to as "Submissions") through the Service. 3. "Registered Work" refers to Submissions registered on this Site. 4. "User" refers to all individuals using this Site. 5. "Derivative Work" refers to a derived "Submission Information" newly created from an "Original Work" through secondary creation. 6. "Derivative Work Submission User" refers to a user who posts "Derivative Works" within the Service. 7. "Work User" refers to a user who utilizes Submissions in accordance with these Terms. 8. "Work Registrant" refers to the individual who originally registered the work on this Site. Article 4: Creation of Derivative Works Users may create Derivative Works using portions or the entirety of Registered Works or any elements contained within the Registered Works (such as copyrighted works, performances, audio, or music included in the Registered Works). Article 5: Relationship Between the Work Registrant and the Company 1. Users may download and use works registered on DouDoujin in accordance with these Terms. Users must understand the cautionary points and prohibited items stipulated in Article 7 of these Terms before downloading works. 2. Management of Registered Works used shall be conducted by the "Derivative Work Submission User" who registered the Registered Work in question. Even if the Work Registrant registers the work, no delegation of authority, business consignment, transfer of ownership, or any other contractual relationship regarding the management of the work shall arise between the Work Registrant and the Company. Article 6: Relationship Between the Work Registrant and Work User 1. Even if the Work User uses Registered Works in accordance with these Terms, no rights to the Registered Works shall be transferred from the Work Registrant to the Work User. 2. Except for usage explicitly permitted in these Terms or in the individually set usage conditions for Registered Works, no rights to use Registered Works or Derivative Works shall be granted to the Work User. 3. Use of Registered Works shall be at the discretion and responsibility of the Work User. The Work Registrant makes no guarantees to the Work User regarding the Registered Works, including but not limited to the Registered Work fulfilling the Work User’s intended purpose, freedom from damages due to usage, or non-infringement of third-party rights. Article 7: Work User of Registered Works The "Derivative Work Submission User" grants permission for the Work User to use Registered Works and Derivative Works in accordance with these Terms and the usage conditions set for the Registered Works (hereinafter referred to as "this License"). Work Users on external sites outside of this Site must adhere to both these Terms and any individually established usage conditions for each Registered Work. 1. Usage Conditions of Works When using works, the Work User must clearly indicate that the work is being used from DouDoujin by including the URL of the relevant work page as a citation. Even if there is no place to include a URL in the service's specifications, the Work User must make it clear to third parties viewing the Derivative Work that it is cited from a work on DouDoujin through an identifiable form of expression. 2. Scope of Use The use of works is permitted solely for non-commercial purposes on the internet. However, even on sites running monetization programs, use is permitted under this License as long as it does not fall under prohibited activities stipulated in these Terms. The following actions are excluded from this scope: (1) Outside the Scope of Usage Conditions a. Posts made by corporations or other organizations, or posts made as part of the duties associated with the poster’s organization. b. Use for commercial purposes. If any of the above applies, the use falls outside the scope of these Terms, and separate permission must be obtained from the Work Registrant. Requests for use must be directed to the Work Registrant by the requester, with conditions mutually agreed upon by the involved parties. The Company shall not be involved in disputes concerning the registration or use of works, and disputes shall be resolved between the parties involved. (2) "Commercial Purposes" as Defined by DouDoujin a. Any case where the Work User or a third party directly obtains monetary or other economic benefits, or could potentially do so, from the use of a Registered Work or its Derivative Work, regardless of the stated purpose (e.g., if a Derivative Work is made available for paid download). b. Use of Registered Works or Derivative Works for the purpose of advertising or promoting a specific product, service, store, or organization. c. Actions that involve posting multiple Registered Works collectively on a website for the sole purpose of increasing traffic or generating revenue through affiliate links based on increased traffic. d. Actions equivalent to the above. e. However, the following uses are excluded: i. Use in posts on generally free-to-view video sites, such as YouTube. ii. Use in posts on generally free-to-use social media sites, such as X (formerly Twitter). iii. Use on other generally free-to-use online services where the work’s promotion does not infringe upon the interests of the Work Registrant. 3. License Period The license for the use of works specified in these Terms shall terminate if the "Derivative Work Submission User" withdraws from DouDoujin by deleting their account or if the "Original Work" or "Derivative Work" is deleted from this Site. 4. Points to Confirm When Using Works (1) Notwithstanding the provisions of these Terms, both the Company and the Original Work Submission User retain the right, as authors, to protect their moral rights (such as honor, reputation, display of authorship, and work integrity) and may halt the publication of Derivative Works derived from their own works. (2) The usage conditions for works in these Terms are as of the time of publication, not the time of download. The Original Work Submission User and Derivative Work Submission User may cancel their submission or withdraw their membership, thereby rendering works unusable. Therefore, users must check the latest usage conditions at the time of publication. When using an Original Work or Derivative Work, the Work User is obligated to confirm the latest usage conditions and these Terms at the time of publication and to comply with the applicable usage conditions and Terms. Article 8: Prohibited Activities When using Registered Works or Derivative Works, Work Users are prohibited from engaging in the following activities: 1. Using the content in a way that damages the image of the original author. 2. Engaging in acts that infringe or may infringe on the rights of others. 3. Reselling or otherwise distributing "Original Works" or "Derivative Works" without the permission of the original creator. 4. Reselling or otherwise distributing videos, music, still images, or other creative works derived from "Original Works" or "Derivative Works" without the permission of the original creator. 5. Converting "Derivative Works" into physical items and distributing them. 6. Implying or leading others to believe, falsely, that they are sponsored or partnered with DouDoujin or its affiliates. 7. Posting content that lacks creative input or commentary from the Work User, such as posts that are merely copies of works posted on DouDoujin. 8. Content deemed grossly inappropriate according to societal standards, including excessive sexual expression, slanderous content against specific individuals, organizations, races, and content specified as follows: a. Content that violates laws in any country. b. Content that infringes upon the intellectual property rights associated with copyrighted works posted on DouDoujin. c. Content obtained using cheats, hacking, unauthorized access, technical restriction circumvention, unauthorized modification, or tools, services, or means enabling these. Article 9: Scope of Use for Works No Longer Publicly Available 1. The Work Registrant may terminate the license for use by users by deleting their work posted on this Site. 2. When a DouDoujin account is deleted, all works registered by the Work Registrant will be automatically deleted. Works that are no longer available for viewing on this Site fall outside the scope of usage rights as stipulated in these Terms. Additional Information: Copyright Infringement Claims If you wish to request the removal of unauthorized copies of copyright-protected content, please submit a copyright infringement claim through the DouDoujin inquiry form under the Digital Millennium Copyright Act (DMCA).
